The maximum State fine amount for a health facility allowed by law is $10,000. This fine could be doubled or trebled (tripled) for repeat offenses for a maximum fine of $30,000. [See Iowa Code 135C 36-44A]

As of May 1, 2024, state law requires that an ambulatory surgical center obtain a license from DIAL in accordance with Iowa Code section 135R. An ambulatory surgical center seeking licensure should contact John Osborne [john.osborne@dia.iowa.gov, (515) 422-8605] at DIAL to request an application. DIAL will consider an application after it receives the completed application, the required building and plan review, and the $50 fee.

The following facilities are not State-licensed or subject to State fines: hospitals, rural health clinics, end-stage renal disease centers, home health agencies, hospices, outpatient physical therapy and speech, portable x-ray facilities, comprehensive outpatient rehabilitation facilities, or community mental health centers.
